Considers the Council and European Parliament Directive 2004/48/EC on the Enforcement of intellectual property rights presenting its history, objective and contents. Reviews the legislation adopted in Romania for the implementation of the civil measures, procedures and remedies provided by the Directive 2004/48/EC. Focuses especially on the implementation of the ex‑parte injunctions, the measures to disclose and preserve evidence and the award of legal costs. Assess the effective application and enforcement of the implementation acts examining the jurisprudence and also the critical opinions of the practitioners and doctrine.
