Copyright in Romania and harmonization the reof under the European norms. Progress and current situation after the accession of Romania to the European Union

As a former socialist state in the Eastern Europe, Romania’s initial task and challenge after 1989 was to reorganize the legal relationships in the intellectual property field, in particular copyright, and to adapt to market economy conditions. As regards copyright, the first stage of this process was achieved relatively late, in 1996, by adopting the new regulations in the field: (Law of March 14th, 1996). During Romania’s preparation and accession to the European Union on January 1st, 2007, the need of a systematic adaptation of Romanian copyright to the legal framework of the Community Law (acquis communautaire) gained shape. This adaptation was effected during several stages, in particular by two „reform packages” from 2004 and 2005/2006. On this basis, the current status of the copyright norms in force in Romania is analyzed, in particular the very complicated standardization with bureaucracy expansion tendencies regarding management companies. Additionally, the analysis is done based on the „five pillar pattern” for a modern standardization of copyright as an overall system.
